Transitional application – Special Rule 14

If you are an entity including an individual providing BAS services for a fee or other reward, then you are required to register under the new regime in order to provide those services.

Anyone providing BAS services who does not meet the formal education and experience requirements that exist for a standard application for registration, may be able to use the transitional application option. You will have until 28 February, 2013 to comply with the new law including meeting the educational qualifications and relevant experience requirements. When applying for transitional registration you must be able to demonstrate that you were providing BAS services to a competent standard and for a reasonable period (at least 700 hours over the last two years).

Upon renewal, you will need to satisfy the requirements of a standard application, including the educational and experience criteria.

The application fees for BAS agent transitional application and standard application are:
$100 - for registration as a BAS agent who carries on a business
$50 - for registration as a BAS agent who does not carry on a business.

The Board can impose conditions on your registration and may require professional indemnity insurance coverage from 1 July 2011. If you currently hold professional indemnity insurance, the Board strongly encourages you to continue that coverage.

Register for transitional application Special Rule 14

To register, you will need to create an account. When your account is created you can then complete the online BAS transitional application form. You will need to attach evidence that you have provided BAS services to a competent standard and for a reasonable period.

NOTE: Employees who provide BAS services for their employer are not required to register. However, where the employer is a BAS agent providing BAS services for a fee, via a partnership or company, then the employer requires a sufficient number of individuals being registered BAS agents to provide the BAS services. In this situation, an employee may register as an individual who does not carry on a business.
